Lahore High Court rules husband cannot reclaim 11 tola gold in divorce case.
Lahore: (RightNow) The Lahore High Court has announced a decision in a 15-year-old divorce case. The court stated that the husband is not entitled to reclaim the 11 tola gold given by the wife’s father. The husband failed to provide reliable proof of purchasing the gold.
The court partially accepted the woman’s appeal and rejected the husband’s request. This decision was issued in an 18-page written document.
In 2018, the Family Court ordered the woman to return 11 tola gold or its value to the husband as part of the divorce settlement. The Session Court upheld this decision in 2020.
The Lahore High Court dismissed the husband’s request, affirming that the maintenance of the minor child is the father’s legal and social responsibility. The court maintained the annual increase rate of 10% in maintenance.
It is noteworthy that the woman filed a claim in 2011 for divorce, maintenance, dowry items, and the return of gold. The husband had filed a request in court to reclaim the gold.
