Lahore: (RightNow) The Federal Constitutional Court has dismissed the appeal by Lahore Electric Supply Company (LESCO). The court upheld the Lahore High Court’s decision regarding average billing by a private laboratory.

A two-member bench led by Justice Aamir Farooq heard the case. During the hearing, the court stated that the responsibility for meter malfunction lies with the company. LESCO owns the meter, and no blame can be placed on the consumer.

LESCO’s lawyer argued that both the front and backup meters of the consumer were faulty, leading to average billing. The laboratory’s lawyer, citing a fact-finding report, stated that the backup meter was not faulty.

The laboratory’s lawyer further explained that if the front meter is faulty, the backup meter automatically takes over. The court accepted these arguments and dismissed LESCO’s appeal.

It should be noted that the Lahore High Court had previously rejected a similar appeal by LESCO.
