The Supreme Court rules that child support should align with the father’s financial capacity, upholding the Sindh High Court’s decision.
Islamabad: (RightNow) The Supreme Court has delivered a significant verdict on determining child support for minors. The court stated that child support should be set according to the father’s financial capacity and social status. Interference with the amount set by lower courts will only occur in cases of clear legal violations.
A two-member bench comprising Justice Irfan Saadat Khan and Justice Aqeel Ahmed Abbasi rejected the appeal of Ms. Shaheen Nawaz, upholding the Sindh High Court’s decision. The appellant argued that the child’s father is a manager at a textile company in Bangladesh, earning a good salary.
According to the Supreme Court’s decision, the Family Court had set the child support at Rs. 30,000 per month, with a 15% annual increase. The Sindh High Court also upheld this decision.
The court declared that both the appellate court and the high court thoroughly reviewed the father’s income, financial resources, and the child’s needs. The father is also responsible for supporting two other children from his first marriage.
It is noteworthy that in the Muhammad Imran Baqar case, the Supreme Court also stated that child support should be determined based on the father’s financial capacity. The appellant failed to prove any legal flaw in the lower courts’ decisions.
