Islamabad: (RightNow) Under Article 232 of Pakistan’s Constitution, an emergency can be declared in case of war or internal unrest. A provincial assembly resolution is necessary for its enforcement, but the President can also announce it.

According to Article 232, the emergency declaration must be presented to Parliament within 10 days. If not approved by Parliament, the emergency ends after 2 months. During an emergency, Parliament can enact special legislation.

Upon emergency enforcement, certain provincial powers transfer to the federal government. The federal government can issue directives to the provincial government, and federal laws take precedence over conflicting provincial laws.

It is clear that during an emergency, the President cannot directly take over provincial assembly powers. Special laws become ineffective 6 months after the emergency ends.

Remember, Article 233 of the Constitution explains the impact on fundamental rights during an emergency. Some rights may be suspended, which the President presents to Parliament.
