The Supreme Court upheld Peshawar High Court’s decision, allowing land acquisition with market value consideration.
Islamabad: (Right Now News) The Supreme Court has stated that the state can acquire land for public interest, but the actual market value must be considered. The court has rejected the objections of the Khyber Pakhtunkhwa government in the Swabi land case.
The Supreme Court in its decision emphasized that the actual market value of the land cannot be ignored, and compensation cannot be given based solely on government rates. The decision of the Peshawar High Court has been upheld.
The court further stated that the principle of land compensation must be adhered to, ensuring fairness in the process.
This decision is significant as it reinforces the importance of fair compensation in land acquisition, impacting future cases and government policies.
It is noteworthy that the Peshawar High Court had previously ruled in favor of considering the market value in land compensation, which the Supreme Court has now affirmed.
