Lahore High Court rules appeal against Punjab Property Tribunal’s interim order inadmissible, disallowing any appeal or review.
Lahore: (RightNow) The Lahore High Court has declared the appeal against the interim order of the Punjab Property Tribunal inadmissible. The court stated that no appeal or review can be filed against the tribunal’s interim order.
Justice Chaudhry Muhammad Iqbal issued a written decision on petitions including that of Ayaz Ahmed. The court noted that the tribunal has the authority to issue interim orders regarding property possession. Appeals or reviews can be filed after the final decision.
The decision highlighted that the purpose of the Punjab Protection of Ownership Property Act is to eliminate unnecessary litigation. The tribunal granted land possession to the other party based on the District Scrutiny Committee’s report.
The court upheld the tribunal’s interim order. The Property Tribunal had issued an interim order to provide hereditary land to the other party.
It is noteworthy that no forum for appeal or review through a constitutional petition is provided against the tribunal’s interim order.
